Yoga Therapy Institute Terms and Conditions

  1. Application of these Terms & Conditions

    a) In these Terms & Conditions, the terms “we”, “us”, “our” or “YTI” are a reference to Yoga Therapy Institute Pty Ltd ACN 134 875 595.

    b) These Terms & Conditions apply to:
    i) Courses and Overseas Retreats offered by or through YTI;
    ii) the browsing and/or use of the Website and the purchase of Courses and Overseas Retreats
    iii) and any other interaction you have with YTI.
    iiii) If you do not agree to these Terms & Conditions, you must not purchase or attend any Courses or Overseas Retreats, or use the Website.

  2. GCYT, other Courses and Overseas Retreats
    a) Delivery of and attendance at YTI Courses and Overseas Retreats is subject to the prevailing COVID requirements; as directed by local, state or federal government or government department or by law or regulation; and by the venue for in-person Courses, as these change over time.

    b) Graduate Certificate in Yoga Therapy (GCYT) Course:
    i) GCYT students must read and comply with the:
    1) Code of Conduct, and 
    2) Medical Disclaimer.
    ii) GCYT fees terms and conditions are set out in clause 5)c).
    iii) Recording with any type of recording device (audio, video or photo) is strictly prohibited, except as set out in clause 4) or where explicitly agreed for assessment purposes by all relevant parties during the GCYT Course.

    c) All other Courses and Overseas Retreats:
    i) Students and attendees of Courses and Overseas Retreats must comply with the Medical Disclaimer.

    d) Substitution of Course delivery methods and dates
    i) We reserve the right to substitute teachers, trainers, presenters, Overseas Retreat facilitators or conference speakers if they become unavailable due to ill health or other exceptional circumstances.
    ii) We reserve the right to convert face-to-face Courses to an online format to be delivered via zoom or other online platform, and/or change delivery dates, where minimum attendance numbers have not been met, or where there are border closures or weather events that impact the ability of our presenters and/or attendees to travel to the Course location.
    iii) We will give you reasonable notice of this change. We recommend that you confirm with YTI that the minimum attendance numbers have been met for your Course prior to booking any travel, particularly if it is non-refundable or inflexible. We also recommend you purchase appropriate travel insurance.
    iii) We reserve the right to change venues if required.

  3. Overseas Retreats
    a) This clause applies to Overseas Retreats.

    b) If you are booking an Overseas Retreat that requires you to travel outside of your home country, please ensure that:
    i) you have adequate travel insurance in place before making your booking, and
    ii) we have met minimum numbers of attendees before booking any flights, particularly if the flights are non-refundable or inflexible.

    c) Overseas Retreat Fees are non-refundable, except:
    i) as required by law,
    ii) where we notify you that the Overseas Retreat is cancelled, including where minimum numbers of attendees have not been achieved.

    d) Where YTI or the Overseas Retreat operator postpones, cancels or reschedules the Overseas Retreat due to government policies or directions, border closures or other factors outside our control, Overseas Retreat Fee deposits are non-refundable.
    e) Should you wish to arrive at the Overseas Retreat before it commences, or stay after the conclusion of the Overseas Retreat, all additional fees including but not limited to transfers, accommodation, meals, and sightseeing will be payable by you in addition to the Overseas Retreat Fee.

    f) If you choose to arrive after the Overseas Retreat commences or depart the Overseas Retreat earlier than the scheduled end date, the Overseas Retreat Fee will not be refunded or pro-rated. Any additional private services required will be charged as quoted.

    g) Airport transfers are included in the Overseas Retreat Fee when you arrive on the scheduled flight from Singapore (India trip) or Bangkok (Bhutan trip). If you are unable to join that flight, the cost of a private transfer will be added to your Overseas Retreat Fee.

    h) Overseas Retreats held in conjunction with our travel partners are also subject to the travel partner’s terms and conditions.

4) Participation in Marketing

a) During Courses, the GCYT Course and Overseas Retreats we may take photographs, videos or sound recordings to be used for the purposes of YTI marketing and publications.

b) We will advise you prior to making such recordings and you may opt-out of participating by advising the facilitator at that point in time.

5) Fees and Payments

a) Course fees and refunds
i) In order to secure your access to a Course, you must pay the fee specified. If you have paid a deposit, you must pay the remainder of the fee prior to the Course start date, or you will not be granted access to the Course, unless otherwise agreed.
ii) We accept online payments for Course fees and in some circumstances may be able to facilitate a direct deposit – please contact us for more details.

b) Refunds for Course fees (excluding GCYT Course)
i) Except where required by law, YTI provides refunds in our absolute discretion.
ii) Where YTI cancels a Course, we will refund Fees paid within fourteen days of the date YTI advises you of the cancellation.
iii) Please select your Course carefully. We do not provide refunds if you change your mind or make the wrong choice of Course. Please note that we are NOT able to transfer your enrolment to another person.

c) GCYT Course Fees and Refunds
i) The following terms apply to the Graduate Certificate in Yoga Therapy Course (GCYT Course).
ii) The GCYT Course fee is $8500. A discount may be available for early bookings at YTI’s absolute discretion – please email [email protected] for more details.
iii) A deposit of $1000 is payable at the time you submit your application for enrolment (GCYT Deposit). 
iv) If you choose to cancel your GCYT enrolment for any reason within five business days of submitting the application form and paying the GCYT Deposit (Cooling-off Period), we will refund the GCYT deposit. Please allow 10 days for your refund to be processed.
v) Except where required by law, after the Cooling-off Period has expired, the GCYT Deposit is non-refundable.
vi) If you withdraw from the GCYT Course six months or more in advance of your GCYT Course start date, we will refund you the GCYT Course Fees you have paid, less the GCYT Deposit.
vii) If you withdraw from the GCYT Course between three and six months in advance of your GCYT Course start date, we will refund you 50% of the GCYT Course Fees you have paid, less the GCYT Deposit.
viii) Except as set out in subclauses iv) to vii) above and as where required by law, all GCYT Course Fees paid prior to your GCYT Course start date are non-refundable.
ix) If you withdraw after your GCYT Course start date, all GCYT Course Fees paid are non-refundable.
x) A payment plan can be arranged at YTI’s discretion to pay the GCYT Course Fees over a 12-month period. The full cost of the GCYT Course on a payment plan is $9080.

d) Online credit card transactions – YTI uses the eWAY Payment Gateway for its online credit card transactions. eWAY processes online credit card transactions for thousands of Australian merchants, providing a safe and secure means of collecting payments via the Internet. All online credit card transactions performed on this site using the eWAY gateway are secured payments. Payments are fully automated with an immediate response. Your complete credit card number cannot be viewed by YTI or any outside party. All transactions are performed under 128 Bit SSL Certificate. All transaction data is encrypted for storage within eWAY’s bank-grade data centre, further protecting your credit card data. eWAY is an authorised third-party processor for all the major Australian banks. eWAY at no time touches your funds; all monies are directly transferred from your credit card to the merchant account held by YTI.

6) Intellectual Property

a) All Course materials, including notes and presentations, are protected by copyright. Except as permitted by copyright law, you may not reproduce or communicate any of the Course content from the Website or the YTI sharefile, including notes and presentations, without the copyright owner’s consent.

b) All content on the Website, including text, icons, graphics, etc are the property of YTI or its suppliers, and is protected by Australian and International Copyright law. No part or portion of this Website may be copied, sold, altered, reproduced, published, transmitted or used in any manner for any commercial purpose without written consent from the relevant copyright owner.

c) All logos and trademarks that are primarily displayed on the Website are owned by YTI. Other trademarks displayed are trademarks owned by their respective owners and used under licence. You must not use or distribute any trademark featured on the Website without the written consent of the trademark owner.

7) Links to third party websites

The Website may include links to other websites operated by third parties that have separate and independent policies and terms of use. YTI takes no responsibility or liability for the content and activities of these linked websites. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites.

8) Termination of Website access

YTI may terminate access to this Website at any time without notice.

9) Limitation of Liability

a) In participating in or attending a Course, the GCYT or an Overseas Retreat, you represent that your physical and mental health is at a sufficient level appropriate for the relevant Course, the GCYT or Overseas Retreat. You agree that you have no medical conditions that will prevent your participation in the relevant activities.

b) You agree that it is your responsibility to consult with an appropriate medical professional prior to and regarding your participation and you will follow your medical professional’s advice. You agree that YTI reserves the right in its absolute discretion to refuse your participation in a Course, the GCYT or Overseas Retreat on medical or fitness grounds.

c) You acknowledge that participating in any of the relevant activities could result in physical changes or injuries and that you will stop any activity before you become ill or injured. It is your continuing responsibility to inform YTI or its facilitators of any conditions or injuries prior to participating in an in-person activity.

d) You assume full responsibility for any risk, injury, or damages, known or unknown, which you incur as a result of participating in a Course, the GCYT or an Overseas Retreat.

e) You knowingly, voluntarily, and expressly waive any Claim you have against YTI, its owners, employees, instructors, teachers, volunteers and/or independent contractors (the Indemnified) for any Claim you sustain because of participating in any Course, the GCYT or an Overseas Retreat, even where the Claim arises due to negligence or wilful misconduct of any person.

f) You agree to indemnify and hold harmless the Indemnified from any loss or liability incurred in defending any Claim made by any person on your behalf.

10) Privacy

11) Force Majeure

YTI will not be in breach of these Terms & Conditions or any way liable to you for refunds, if it is prevented from conducting Courses or Overseas Retreats by reason of act of God, act of public enemy, war, earthquake, riot, flood, explosion, compliance with any law or government restraint order, rule, regulations, strikes, lock outs or any other cause not reasonably within the control of YTI.

12) Delivery

a) Physical delivery – after ordering online, you will receive an email confirmation from eWAY containing your order details (if you have provided your email address). We will normally confirm receipt of your order within a few minutes of ordering. Please allow for 24-48 hours for processing of your order. After that, we will attempt to send your goods via Australia Post within 1-3 days; however if goods are unavailable delivery will take a little longer. If you wish to query a delivery please contact us at [email protected].

b) Digital Delivery – after ordering online, you will receive an email confirmation from eWAY containing your order details (if you have provided your email address). We will normally confirm receipt of your order within a few minutes of ordering. We will attempt to send your software/license/access code via email within 24 hours. 13) Capacity to contract

a) You may only purchase from YTI if you have the capacity to contract. Our Website, Products, Courses, Events and Overseas Retreats are all directed to people who are at least 18 years old or older. If you are under 18 (a Minor), you may only use www.yogatherapyinstitute.com.au or purchase from YTI under the supervision or involvement of your parent/s or guardian/s.
b) If you are a Minor, you are not eligible to attend ANY of our Courses or Overseas Retreats

14) Governing Law

These Terms & Conditions are governed by the laws of the state of New South Wales.

15) Amendments

The Terms & Conditions are subject to change from time to time without notice. We reserve the right to change, modify, add or delete parts of the Terms & Conditions at any time. Amendments will be effective immediately; and it is your responsibility to review our Terms & Conditions for any changes. Your continued use of the website following any amendment will represent your acceptance to the revised Terms & Conditions.

16) Definitions

In these Terms & Conditions, the following terms are defined as follows:

Claimincludes but is not limited to any and all liabilities, claims, demands, expenses, fees, legal actions, rights of actions for damages, personal injury, or death that you may suffer (including any legal fees or expenses) in connection with participation in any Course, the GCYT or Overseas Retreats.
Code of Conductmeans the rules set out at https://yogatherapyinstitute.com.au/gcyt-code-of-conduct/ as amended from time to time.
Coursemeans the events, workshops and courses run and/or marketed by YTI, delivered online or in-person.
GCYTmeans the Graduate Certificate in Yoga Therapy Course.
Medical Disclaimermeans the rules set out at https://yogatherapyinstitute.com.au/medical-disclaimer-yoga-therapy-institute/ as amended from time to time.
Overseas Retreatsmeans the retreats delivered in overseas locations that may be facilitated by YTI from time to time, but does not include  online events that are accessed from overseas.
Websitemeans the website found at https://yogatherapyinstitute.com.au
